Plan Commission Meeting Minutes

1.Meeting called to Order by Bev Vaillancourt at 6:30 PM.
Roll call: Present – Bev Vaillancourt, Dick Fish, Darrick Geitz, Tom
McManamy and Jack Roloff.    Absent-none
2.Motion to adopt agenda with amendments made by McManamy, second by
Geitz, motion carried.
4.Motion to approve minutes from last meeting by Geitz, second by
Fish.
5.Review CSM combining Lots 25 and 25 Original Addition Lake Redstone
prepared by Blakeslee land Survey.  These lots have major draining
issues so they want to combine the lots into one which would also be
required to put in a new septic system. Fish made a motion to approve,
Roloff second, motion approved.
6.Review Mike Dimmer’s proposed storage buildings for E3350 Mini Creek
Road.  It was stated that this site must be compliant with all state
and local requirements.  Must have storm water management, erosion
control plan and a landscaping plan.  The Plan Commission needs to
review the engineering plan once it is created.  Motion made by Roloff
and second by McManamy.  Motion approved.
7.Review CSM creating 2 parcels located in Lots 7,8,9 and 10 of the
Vacated Douglas Addition.  Originally the land was in 4 parcels owned
by one person.  Both owners are deceased and the children want to sell
of half of the land.  They would like to take these 4 lots and make
them into 2 lots, lot 1 is going to be sold at auction and lot 2 is
going to be kept by the children.  Motion to accept the CSM made by
Fish, second by Geitz.  Motion approved, Roloff abstained form
voting.
8.Review draft of Encroachment Ordinance.  There were no comments from
the Town Board.  Things that were brought up by the Plan Commission
was:  not all roads were put in the middle of the right away so
considering the easement is 33 feet on each side of the road is a
little touchy in knowing exactly where the encroachment should be. 
With encroachments cannot be within the platted right away or 33 feet
of the center line.  So something might be out of the platted right
away, but if the road was not centered it could still be out of
compliance.  It was also stated that the Town only has authority for
town roads only, no jurisdiction on any county or state roads.  What
was recommended by the Plan Commission was to have Fish make a few
more changes, once that is complete the ordinance should be sent to
the attorney.  Once the attorney is done it should come back to the
Plan Commission to review one more time before it is sent to the Town
Board for approval.
9.Town of La Valle Land Division and Subdivision Ordinance.  We
reviewed the document Fish put together.  It was decided that through
the process flow of the whole application process the Plan Commission
will be the ones that will review and determine if the application is
complete.  We are to add a public hearing section so everyone has the
opportunity to be notified when a subdivision is being proposed.  A
section will be added for archeological, cultural and historic sites. 
The next step is to make these final adjustments, then the Town Board
is to review and the Town Board will then send it to the attorney.
10.Update on wind turbines.  The county is still looking at this.  
The state will not allow the county or towns to have any stricter
regulations than they do, so we have to be very careful on what we
propose on this subject.
11.Next meeting date set for September 8, 2009 at 6:30 PM.
12.Motion to adjourn by Fish and second by Geitz.  Meeting adjournmen
